Simployer One supports overlapping leaves to ensure correct handling of absences across different leave types, while complying with national regulations. This guide explains how overlapping leaves are handled in the system, including the support for the Norwegian Holiday Act.
1. General rules for overlapping leaves
There are some general rules that applies to all overlapping leaves.
1.1 Leaves of the same type
Leave periods of the same leave type cannot overlap.
Example: A vacation leave cannot overlap with another vacation leave.
Consecutive leave periods are allowed, as long as the dates do not overlap.
1.2 Exception: Sick Leave
Sick leave is allowed to overlap with other sick leave periods.
This supports common scenarios such as:
A doctor issuing a new sick leave with a different absence percentage
A sick leave being extended, starting from the current day
2. Default Strategy (All other countries except Norway)
For all countries except Norway, a default overlap strategy applies.
2.1 Sick leave and vacation
100% sick leave takes priority over vacation
If sick leave grade is 100%, it overrides vacation on overlapping days
If sick leave grade is less than 100%, vacation retains priority
2.2 Other leave type combinations
Other leave types may coexist:
Each leave keeps its full number of minutes
All leaves are counted toward used days and statistics
3. Norwegian Strategy (Employees employed in Norway)
For employees employed in Norway, overlapping leaves are handled according to the Norwegian Holiday Act. The primary objective is to ensure correct treatment of vacation when combined with sickness or other qualifying absences.
3.1 Postponement demand for vacation
A postponement demand applies to vacation leave for employees employed in Norway.
This allows employees to:
Fully postpone planned vacation, or
Recover vacation days that overlapped with sickness
Whether a postponement is valid depends on:
The date the sickness occurred
The absence percentage (grade)
The date the postponement demand was submitted
(in accordance with the Holiday Act)
3.2 Other leave types in Norway
Other leave types may coexist:
Each leave keeps its full number of minutes
All leaves are counted toward used days and statistics
4. Sick leave certificate issue date
An optional field for Certificate Issue Date is available on sick leave.
This allows the system to reflect the actual date the medical certificate was issued
It ensures more accurate handling of overlaps and follow-up logic than relying solely on the registration date
5. Auto-closing self certified sick leave
Simployer One supports automatic closing of self-certified sick leave in specific scenarios.
5.1 Automatic Closure
If an employee registers a self-certified sick leave without an end date, and
A medical sick leave is later received that:
Starts within the allowed duration of the self-certified sick leave
In these cases:
The self-certified sick leave will be automatically closed when the medical sick leave is entered.
5.2 When automatic closure does not apply
If the medical sick leave starts outside the allowed duration of the self-certified sick leave:
The self-certified sick leave is not closed automatically
Manual handling is required
5.3 Backdated medical sick leave
Support is included for backdated medical sick leave:
When a doctor issues a sick leave with a retrospective start date, and
The employee was on self-certified sick leave during that period
In these cases:
The certificate receipt date is decisive
Self-certified sick leave takes priority over medical sick leave for overlapping periods up to the certificate issue date
